Privacy Notice

1. Who is responsible

MAR Creative Intelligence is the trading name under which the services are provided. The controller of your personal data is ASM Global Solutions Enterprise, S.A. de C.V., with its address in Mexico City, Mexico.

You can contact us about anything in this notice on WhatsApp, at the number published on this site.

2. What data we handle

We collect only what we need to quote, deliver and improve the service:

• Contact details. Name, company, phone, email and the social account you message us from.
• Business information. How your business operates, the kind of client you serve, your offer, commercial goals and current content volume. You provide this in the onboarding form and in working sessions.
• Working material. Scripts, recordings, images, testimonials, cases and any file you hand over for production.
• Public social data. Publicly visible metrics and posts on your brand's accounts. See section 4.
• Conversations. WhatsApp messages, email and follow-up calls related to the service.
• Site preferences. Light or dark theme and motion preference, stored in your own browser. See the cookie notice.

This website contains no forms. First contact happens over WhatsApp, and anything you share there is also subject to WhatsApp's (Meta's) own policies.

3. What we use it for

Necessary purposes, without which we cannot deliver the service:

• Responding to quote requests and defining scope.
• Delivering the contracted services: strategy, production, editing, measurement and web development.
• Managing hosting, domain and renewals where the service includes them.
• Invoicing, collections and meeting tax and contractual obligations.
• Support, follow-up and operational communication.

Additional purposes, which you may decline without affecting your service:

• Showing the work as a case study or portfolio piece, with your prior written authorisation.
• Sending you updates about new services or content.

To opt out of the additional purposes, just tell us through any contact channel.

4. Public social data

As part of the service we analyse only publicly visible information on your brand's accounts: posts, open metrics, public comments and sector reference content.

We do not access private messages, buy databases, extract information from private profiles, or attempt to identify individuals from it. The analysis informs topics, messages and formats — it is not used to profile people.

Where the scope includes publishing or direct measurement, we request only the access strictly required and return or revoke it when the engagement ends.

Where the public activity we analyse includes third-party data (your followers' comments, for instance), we treat it in aggregate and never use it to contact them.

5. Who we share it with

We do not sell personal data. We share it only with providers we need in order to operate, and only as far as necessary:

• Hosting and infrastructure. The provider hosting this site and the associated email.
• Messaging. WhatsApp (Meta), when contact happens on that channel.
• Typefaces. This site loads fonts from Google Fonts, which means Google receives the IP address of anyone visiting the page.
• Advertising platforms. When we run campaigns for our own services, ad providers process data under their own policies.
• Production and storage tools. Editing software, project management and file backup.

These providers process the information on our behalf and on our instructions; we do not authorise them to use it for their own purposes. If you want to know which specific provider is involved in your case, ask us and we will tell you.

We do not transfer data to third parties who would use it for their own purposes, except where a competent authority lawfully requires it.

6. How long we keep it

Our relationships are long-term, so the general rule is simple: we keep your data for as long as you are a client, and afterwards only as long as needed to close the relationship properly or to comply with the law.

Once the relationship ends, these periods apply:

• Contact details and business information — 24 months, in case you resume the service or need us to recover context.
• Production material and deliverables — 24 months. We give you the chance to download them before deletion.
• Working conversations — 12 months.
• Invoicing and accounting records — 5 years, the period Mexican tax law requires and that we cannot shorten.
• Public data analysis — kept in aggregate while the service is active and deleted at close.

You can ask us to delete any data earlier where we are not legally obliged to keep it.

7. Your rights

You may at any time request access to your data, rectification where it is inaccurate, erasure where you believe it is no longer needed, and object to a specific use. You may also withdraw any consent you have given.

To exercise them, send us a request through the contact channels in this notice stating your name, your relationship with us, which right you wish to exercise and a way to reply. We may ask for identification to confirm the request comes from you.

We will answer your request within a maximum of 20 business days of receiving it, as Mexican law requires. Where the request is granted, it takes effect within the following 15 business days.

If you believe your request was not handled properly, you may escalate to Mexico's INAI or to your local data protection authority.

8. Clients outside Mexico

We operate from Mexico City and direct our services and advertising to Mexico and Latin America. If you engage us from elsewhere in the region, your data is processed in Mexico under this same notice.

We do not direct advertising or services to the European Union or the United Kingdom, and this site does not track visitors. If you write to us from there anyway and would rather exercise the rights of your own jurisdiction, we will handle the request like any other.

9. Security

We apply reasonable measures to protect information: access limited to the people who need it, authentication on the tools we use, and an encrypted connection on this site. No measure removes risk entirely, and we cannot guarantee absolute security.

10. Minors

Our services are aimed at businesses and are not directed at minors. We do not knowingly collect data from minors.

11. Changes to this notice

We may update this notice when our services, providers or applicable law change. The current version will always be published at this address with its update date.
