Terms and Conditions
These terms govern use of this site and engagement of the Content Growth and Website Building services. A signed quote prevails over this document wherever it is more specific.
1. Who provides the service
MAR Creative Intelligence is the trading name under which the services are provided. The contracting party, and the issuer of invoices, is ASM Global Solutions Enterprise, S.A. de C.V., with its address in Mexico City.
If the operation later moves to another entity within the same group, we will notify you in writing and the terms described here will carry over.
2. Scope of services
We offer two services, whose concrete scope is always set out in the accepted quote:
- Content Growth. Strategy, idea extraction, scripting, short-form production and editing, distribution according to scope, a dashboard and a monthly learning review.
- Website Building. Architecture, conversion copy, design, development, QA and launch, with ongoing infrastructure management where contracted.
We do not publish fixed prices: each project is quoted according to scope, complexity and goals.
3. Quoting and engagement
The relationship begins when you accept in writing a quote detailing deliverables, timelines, payment terms and duration. Any work outside that scope is quoted separately before it is carried out.
Paid in advance. Each service period, normally monthly, is paid in full before it begins. Work on the period starts once payment is confirmed.
Currency and methods. We invoice in Mexican pesos (MXN) or US dollars (USD) and accept payments from any country; the currency and specific method are agreed in the quote. Bank or payment-platform fees are borne by whoever generates them.
The invoiced amount is the amount due. Exchange-rate movement between the invoice date and the payment date does not change it.
If a payment is late:
- At 2 calendar days past due we send a reminder.
- If by 5 calendar days we have had no response and no payment, we end the relationship and stop work for that period.
- Ending it this way carries no penalty. You can resume later by settling the corresponding period, subject to our availability.
4. What we do not promise
This point is deliberately explicit. We do not guarantee views, leads, sales, search rankings, conversion rates or virality. We build a system for improving messages, creative and decisions with real evidence.
Performance also depends on your offer, your market, your sales process, available traffic and platform decisions, none of which are within our control. Figures shown on this site illustrate the method and are not a promise of outcome.
We recommend a minimum of three months because that window allows more reliable signals to accumulate; it is a methodological recommendation, not a guarantee.
5. Client responsibilities
- Providing agreed information, access, materials and approvals on time.
- Appearing in recordings where the strategy is founder-led.
- Warranting that material you hand over is yours or licensed to you, including testimonials, third-party marks and music.
- Reviewing and approving assets within the defined windows. Approval delays shift the calendar.
- Complying with the regulations that apply to your sector in what you communicate.
6. Intellectual property
Material you hand over remains yours. Final assets produced for you become yours once the corresponding payment is settled.
We retain ownership of our methods, templates, dashboards, components and internal tooling, which do not transfer with the deliverable. We may show the work in a portfolio only with your prior authorisation.
Third-party licensed resources (typefaces, music, stock imagery) remain governed by their own licences.
7. Hosting, domain and continuity
While the service is active, MAR administers hosting, domain and renewals, so that a single party is accountable for technical continuity.
When the relationship ends, ownership passes to you. We transfer the domain and the site to you or to the provider you nominate, and open a migration window to coordinate directly with whoever takes over, hand across the files and answer technical questions.
We do not hold the domain, the site or the files as leverage. The only things we retain are those described under intellectual property: our methods, templates and internal components.
The migration window is 30 calendar days from notice of termination. Within it, coordination and handover carry no additional cost. Technical support you request after that window is quoted separately.
8. Term and termination
You can cancel at any time, with no penalty. There is no lock-in and no exit fee.
When you tell us, we close the current cycle: work already carried out or in production at that moment is invoiced, finished work is delivered, and the migration window from the previous section opens. Nothing already paid for is lost.
We recommend a minimum of three months for methodological reasons — before that there are few signals to decide on — but it is a recommendation, not a contractual commitment.
9. Limitation of liability
To the extent permitted by law, our total liability for any claim is limited to the amount you paid for the service in the three months preceding the event giving rise to it.
We are not liable for indirect damages, loss of profit or opportunity, or interruptions caused by third parties such as social platforms, hosting providers or changes to their policies.
10. Governing law
These terms are governed by the laws of the United Mexican States. Any dispute will be submitted to the competent courts of Mexico City, waiving any other jurisdiction.
